Acceptance of Terms

alboa provides a collection of online resources, including classified ads, and various email services, subject to the following Terms of Use. By using the Service in any way, you are agreeing to comply with the Terms of Use. In addition, when using particular alboa services, you agree to abide by any applicable posted guidelines for all alboa services, which may change from time to time. 

Should you object to any term or condition of the Terms of Use, any guidelines, or any subsequent modifications thereto or become dissatisfied with alboa in any way, your only recourse is to immediately discontinue use of alboa.

Modifications to This Agreement

We reserve the right, at our sole discretion, to change, modify or otherwise alter these terms and conditions at any time.  Such modifications shall become effective immediately upon the posting thereof. You must review this agreement on a regular basis to keep yourself apprised of any changes.

Using alboa

You will post in the appropriate category or area and will not do any of the following bad things:

• violate any laws of our terms of use
• be false or misleading;
• infringe any third-party right;
• distribute or contain spam, chain letters, or pyramid schemes;
• distribute viruses or any other technologies that may harm alboa or the interests or property of alboa users;
• impose an unreasonable load on our infrastructure or interfere with the proper working of the alboa;
• copy, modify, or distribute any other person's content;
• harvest or otherwise collect information about others, including email addresses, without their consent;
• bypass measures used to prevent or restrict access to alboa.

Abusing alboa

Please use the abuse system to tell us about any problems or offensive content that you view on http://www.alboa.ca so that we can keep the site working efficiently. We may limit or terminate our service, remove hosted content and take technical and legal steps to keep users off alboa if we think that they are creating problems or acting contradictorily with the our policies. However, whether we decide to take any of these steps, remove hosted content or keep a user off alboa or not, we do not accept any liability for monitoring alboa or for unauthorized or unlawful content on alboa or use of alboa by users.

Fees and Services

Using alboa is completely free. This includes posting any number of Ads, replying to an Ad, etc.

Content

You understand that all postings, messages, text, files, images, photos, video, sounds, or other materials ("Content") posted on, transmitted through, or linked from the alboa, are the sole responsibility of the person from whom such Content originated. More specifically, you are entirely responsible for each individual item ("Item") of Content that you post, email or otherwise make available via alboa. You understand that alboa does not control, and is not responsible for Content made available through the Service, and that by using the Service, you may be exposed to Content that is offensive, indecent, inaccurate, misleading, or otherwise objectionable. Furthermore, the alboa site and Content available through the alboa may contain links to other websites, which are completely independent of alboa. alboa makes no representation or warranty as to the accuracy, completeness or authenticity of the information contained in any such site. Your linking to any other web sites is at your own risk. You agree that you must evaluate, and bear all risks associated with, the use of any Content, that you may not rely on said Content, and that under no circumstances will alboa be liable in any way for any Content or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed or otherwise made available via alboa. You acknowledge that alboa does not pre-screen or approve Content, but that alboa shall have the right (but not the obligation) in its sole discretion to refuse, delete or move any Content that is available via alboa, for violating the letter or spirit of Terms of Use or for any other reason.

alboa contains content from us, you, and other users. You agree not to copy, modify, or distribute alboa, our copyrights or trademarks. When you give us content, you are granting us a non-exclusive, worldwide, continuous, irrevocable, royalty-free, sub-licensable right to exercise the copyright, publicity, and database rights to that content. If you believe that your rights have been violated, please notify our alboa  and we will investigate the matter. We reserve the right to remove content where we have grounds for suspecting the violation of these terms or of any party’s rights.

Liability

You agree not to hold us responsible for things other users post or do. As most of the stuff on alboa comes from other users, we do not guarantee the accuracy of postings or user communications or the quality, safety, or legality of what’s offered. We also cannot guarantee continuous or secure access to our services. Accordingly, to the extent legally permitted we expressly disclaim all warranties, representations and conditions, express or implied, including those of quality, merchantability, merchantable quality, durability, fitness for a particular purpose and those arising by statute. We are not liable for any loss, whether of money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of alboa, even if you advise us or we could reasonably foresee the possibility of any such damage occurring. Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to you.

Personal Information

By using alboa, you agree to the collection, transfer, storage and use of your personal information by alboa. (the "data controller") on servers located in the United States as further described in our privacy policy . You also agree to receive marketing communications from us unless you tell us that you prefer not receive such communications.

General

These terms and the other policies posted on alboa constitute the entire agreement between alboa and you, superseding any prior agreements. This agreement is governed by the laws of Canada. If we don't enforce any particular provision, we are not waiving our right to do so later. Except for notices relating to illegal or infringing content, your notices to us must be sent by registered mail to alboa, 6255 Camgreen Circle, Mississauga, Ontario L5W 1Y8. We will send notices to you via the email address you provide, or by registered mail. Notices sent by registered mail will be deemed received five days following the date of mailing. We may update this agreement at any time, with updates taking effect when you next post or after 30 days, whichever is sooner. Prohibited Content

The following activities are prohibited from alboa:

• Posting an Ad if you are not located Canada
• Posting an item for sale that is
• not located in Canada
• is illegal to own, buy or sell in your area of residence
• is in the prohibited items list
• Posting multiple Ads that are too similar to each other
• Posting an Ad that serves no other purpose than to send traffic to another web site
• Posting an Ad that defames anyone or contains "hate speech"
• Posting a multi-level marketing or other prohibited job
• Posting pornography, nudity or other prohibited personal

Any Ads or users that do not comply with the alboa Terms of Use will be removed and blocked from the site. Our general rule is that you may not list, buy or sell items or services that are illegal to own, buy or sell in your Province of residence, or that are not bought or sold in compliance with applicable laws and regulations

IMPORTANT: YOU ARE RESPONSIBLE FOR ENSURING COMPLIANCE WITH ALL APPLICABLE LAWS RELATING TO THE ITEM YOU LIST, BUY OR SELL ON THIS SITE.

We specifically prohibit the following items:

• Blood, Bodily Fluids and Body Parts
• Burglary Tools
• Counterfeit currency, stamps or coins
• Counterfeit Products
• Embargoed Goods
• Escort or accompanying services
• Government and Transit Uniforms, IDs and Licenses
• Illegal Drugs & Drug Paraphernalia
• Illegal Services
• Hazardous Materials
• Fireworks, Destructive Devices and Explosives
• Identity Documents, Personal Financial Records & Personal Information (in any form, including mailing lists)
• Items which encourage or facilitate illegal activity
• Lottery Tickets, Sweepstakes Entries and Slot Machines
• Massage services
• Obscene Material and Child Pornography
• Offensive Material
• Pesticides
• Pictures or images that contain nudity
• Police Badges and Uniforms
• Prescription Drugs and Devices
• Prostitution or ads that offer sex, sexual favours or sexual actions in exchange for money
• Recalled items
• Satellite products that violate the Radio communication Act
• Solicitation of other users except by placing an Ad
• Stocks and Other Securities
• Stolen Property
• Tobacco Products
• Used Cosmetics
• Weapons and related items (such as firearms, firearm parts and magazines, ammunition, BB and pellet guns, tear gas, stun guns, switchblade knives, and martial arts weapons)
• The Animal Pedigree Act makes it a federal offence to sell an animal of a recognized breed as purebred, registered or eligible to be registered if it is not.
• Any Ad that violates the Animal Pedigree Act

The following types of Job ads are prohibited on the site:

• Multi-level marketing or pyramid schemes
• Business or job opportunities that require upfront or periodic payments
• Business or job opportunities that pay only commissions, unless the Ad makes it clear that the sole source of compensation would be commission and clearly describes the product or service that would be sold
• Business or job opportunities that require recruitment of other members, distributors or agents
• Ads that are not clear regarding what type of work would be required

Other Posting Policies:

You can post up to 25 different ads per day on alboa. Duplicate ads or ads that are too similar to an existing Ad that you have posted can be posted in two (2) different categories per site within your province. We also ask that you not post outside the province you are located in. If you violate these policies your ads will be deleted (sometimes without notice). Attempting to post after having your ads removed may result in a "blocked" message notifying you that you have posted too many ads. To avoid this, please list whatever you are advertising only once per site within your province. If you want to re-list an item that you are already advertising on the site, delete your existing Ad first.

Posting a listing with a link to another web site for the sole purpose of directing visitors to that web site is not permitted. You may, however, include a link in your post if it is to give the user more information about the item being offered (for example product details, pictures, etc.).

You are not permitted to defame anyone or include "hate speech" directed at individuals or groups in your postings. alboa reserves the right to delete any Ads from the site that are deemed to negatively impact the community. If you encounter any such Ads, please flag it as such or contact us.
